Arizona Revised Statute §13-3601.02 defines aggravated domestic violence charges. A domestic violence charge would mean any offense involving domestic violence as defined by ARS 13-3601.
A domestic violence charge can be increased to aggravated domestic violence if you have two prior misdemeanor domestic violence charges in seven years. Aggravated domestic violence charges apply to convictions of domestic violence in another state, a court of the United States, or a tribal court if the offense would also be a domestic violence offense in Arizona.
If you are charged with aggravated domestic violence in Phoenix or elsewhere in Arizona, you face a Class 5 felony. The default punishment for a first-offense aggravated domestic violence conviction is 2.5 years in state prison.
